OfflineI just heard that NY has outlawed plastic emergency flare pistols, the kind recreational boaters use. Â They claim they are lethal weapons and being caught with one is a felony, subjection you to arrest and prison! Â WTH! Â Its a PLASTIC flare gun. I would explode if you tried to shoot a 12 ga. shotgun shell from it. Â I've used these and they are not high velocity. Â The only way it would kill anybody would be if the muzzle were held against the body when fired. Â These are safety devices, not weapons. Â I Â think the NY law makers have watched too many movies. Â These have a legitimate use as a safety device. Â If they are going to outlaw anything that COULD be used to harm someone, then the list would be endless. Â Screwdrivers could be used as stabbing weapons. Â
I think it comes down to intended use, not evil intent.

OfflineOK, I checked the background on the article I read (was on a Facebook group I belong to) and the article was removed. As rwsem said, NY has had this on the books since the '80's, but there was a recent update to the law. Â It seems that flare pistols that can NOT chamber ammunition ARE legal to own and use, but any flare pistol that will accept live ammo and fire it is considered a firearm and subjects the owner to criminal prosecution. Â
I didn't know there were any flare guns that would fire real live ammo. Â
